Terms of Service

  1. Acceptance of Terms: By accessing and utilizing the services ("Services") provided by Fraud Guard, LLC ("Company," "we," "us," or "our"), you ("User" or "you") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Agreement"). This Agreement represents a legally binding contract between you and the Company. If you do not agree to these terms, do not access or use our Services.

  2. User Responsibilities: You agree to (a) provide accurate, current, and complete information as may be prompted by any registration forms on the Service ("Registration Data"); (b) maintain the security of your password and identification; (c) maintain and promptly update the Registration Data, and any other information you provide to the Company, to keep it accurate, current, and complete; and (d) accept all risks of unauthorized access to the Registration Data and any other information you provide to the Company.

  3. Use of Services: The Services are intended to provide you with assistance in protecting your property title. They are not a substitute for legal advice from a qualified attorney. The Company is not a law firm and does not engage in the practice of law. The use of our Services does not create an attorney-client relationship.

  4. Violation of Terms: Any unauthorized use of our Services or violation of this Agreement may result in termination of your access to our Services, at our sole discretion, in addition to any other remedies available to us.

  5. Intellectual Property: All intellectual property rights in the content, materials, and methodologies used by the Company are owned by or licensed to us. You may not use such content, materials, or methodologies without our prior written consent.

  6. Dispute Resolution: This Agreement and any action related thereto will be governed by the laws of the State of Florida without regard to its conflict of laws provisions. Any disputes arising from or relating to the subject matter of this Agreement shall be finally settled by arbitration in Florida, using the English language in accordance with the Streamlined Arbitration Rules and Procedures of Judicial Arbitration and Mediation Services, Inc. ("JAMS") then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules.

  7. Disclaimer of Warranties: The Company provides the Services on an "as is" and "as available" basis. Your use of the Services is at your own risk. The Company disclaims all warranties of any kind, whether express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement.

  8. Limitation of Liability: To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to, use of, or inability to access or use the Services; (b) any conduct or content of any third party on the Services; or (c) unauthorized access, use, or alteration of your transmissions or content.

  9. Indemnification: You agree to defend, indemnify, and hold harmless the Company, its affiliates, officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of this Agreement; (iii) your violation of any third-party right, including without limitation any copyright, privacy, property, or privacy right; or (iv) any claim that your actions caused damage to a third party.

  10. Changes to the Terms: We reserve the right, at our sole discretion, to modify or replace any part of this Agreement at any time, effective upon posting of an updated version of this Agreement on the Service. It is your responsibility to check this Agreement periodically for changes.
